ABRIDGED VERSION

When you visit our website your IP address is captured and temporarily saved in a log file by our website provider in accordance with data protection regulations. We do this to identify and defend ourselves against attacks and to serve our legitimate interests as permitted in Article 6 (1) f) of the GDPR.

The content management system only places a temporary session cookie which is necessary for a functioning system during your visit to the website. The cookie is used for the purposes of analysis, tracking and other assessments.

Motoren Eberle GmbH itself does not capture and save any data about your visit.

If you send us an email, we collect and process the personal data contained in the email in systems outside the website. All such processing complies with data protection legislation.

2 EXPLANATION OF IMPORTANT TERMS

This Data Protection Statement uses terms which were defined by the compilers of the European Directives and Regulations when the General Data Protection Regulation was issued. In order to improve the understanding of this Data Protection Statement we explain the most important terms below:

Personal data

Personal data means any information relating to an identified or identifiable natural person (called “data subject” from now on). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

A data subject is any identified or identifiable natural person whose personal data is being processed by the person responsible for the processing - for example you as the customer of our company or the user of this website.

Processing

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

The controller or the person responsible for the processing.

The controller or the person responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. To put this in simple terms, we are the controller.

Consent

Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3. DATA PROCESSED ON THIS WEBSITE

In the following section we provide information on the processing of personal data during the use of this website. Personal data in connection with the use of this website is, for example, the name, address, email address and IP address.

As a matter of principle we only process the user’s personal data to the extent that the processing is necessary for the provision of a fully functioning website along with its contents. We also capture personal data if you contact us by email or by using the contact form.

3.1 DATA PROCESSING FOR THE PROVISION OF THE WEBSITE AND CREATION OF LOGFILES

Personal data is already collected on your visit to our website. It is necessary to process the IP address of the terminal you use in order to transmit and display our web pages on your browser. Further information is obtained about the browser on your terminal.

Data protection law obliges us also to guarantee the confidentiality and integrity of the personal data processed by our IT systems.

When we save the IP address the last two blocks of figures are filled with a 0 so that no personal connection can be made from the remaining data.

Logfiles are saved to ensure that the website can function. The data can also sometimes be used to optimise our website and ensure the security of our IT systems. In this connection the data is not analysed for marketing purposes and, in any case, analysis is rendered impossible by the anonymisation of the IP address.

The legal basis for this data processing is Article 6, Paragraph 1, Letter f) of the GDPR. Our legitimate interest within the meaning of this legal norm is the operation of this website and the implementation of the objectives of protecting the confidentiality, integrity and availability of the data.

3.2 USE OF COOKIES

Cookies are used on our website. Cookies are small text files which are placed in your computer via your browser. Cookies neither install nor launch programs or other applications on your computer. They are, however, necessary to provide certain functions on our website. We use session cookies from our system for this purpose; these cookies are automatically deleted from your browser immediately after the end of the visit.

We also use cookies for web analysis purposes; these cookies are saved for a longer period.

You can prevent cookies from being placed by using certain settings in your browser. However, this can have the result of restricting the use of our website.

The legal basis for this data processing is Article 6, Paragraph 1, Letter f) of the GDPR in conjunction with Section 15 of the German Telemedia Act. Our legitimate interest within the meaning of this legal norm is the proper operation of this website.

3.3 DATA TRANSMISSION IN THE COURSE OF EMAIL COMMUNICATION

If you send us an email we collect and process the personal data which you send to us in the email.

This is done so that, if you have contacted us, we can communicate with you by, for example, answering your questions or providing you with the information you requested.

The legal basis for this data processing is Article 6, Paragraph 1, Letter f) of the GDPR. Our legitimate interest within the meaning of this legal norm is communication with customers and prospective customers.

4. PURPOSES OF PROCESSING PERSONAL DATA

If you are one of our customers we process the above-mentioned data to operate our website and to perform contractual obligations owed to our customers.

In the event of enquiries outside an active customer/supplier relationship, we process the data in order to undertake pre-contractual activities.

5. Informationen zur Speicherdauer Ihrer Daten

The personal data we have processed is deleted or disabled as soon as the purpose for which the data was saved is no longer relevant. Data can also be saved if this is provided for in the European or national regulations, laws or other requirements enacted by European or national legislative bodies and to which the controller is subject. Data also is disabled or deleted at the end of a retention period stipulated in the legal norms mentioned above unless it is necessary to retain the data for a longer period in order conclude or perform a contract.

If the data is processed in connection with an existing customer relationship, we save the data we have collected having regard to the overall context and also our contractual obligations which arise from the existing customer relationship.

If we receive enquiries from you outside an active customer/supplier relationship we save the data until the enquiry has been completed in so far as other legal requirements do not prohibit this.

6. INFORMATION ON YOUR CONSENT

If we process your personal data on the basis of your consent, you have the right to revoke your consent at any time without affecting the lawfulness of the processing undertaken with your consent up to the time your consent is revoked.

7. INFORMNATION PROVIDED VOLUNTARILY OVER AND ABOVE THE DATA WE COLLECT

If you provide data voluntarily, for example in forms, and this data is not necessary for the performance of our contractual obligations, we process this data on the assumption that the processing and use of the data is in your interest.

8. RECIPIENTS OF THE DATA CALLECTED FROM YOU AND ONWARD TRANSMISSION OF THIS DATA

Data you send to us via this website is not passed to third parties as a matter of principle. In particular, your data is not passed to third parties for their promotional purposes.

However, we use service-providers to operate this website, for example our Internet service-provider. It can happen that a service-provider we use becomes aware of personal data. We select our service-providers carefully, particularly with regard to data protection and data security, and we undertake all the actions needed under data protection legislation for lawful data processing.

9. DATA PROCESSING OUTSIDE THE EUROPEAN UNION

We do not process your personal data in what is called a third country outside the European Union.

10. INFORMATION ON THE EXISTENCE (OR OTHERWISE) OF AUTOMATED DECISION-MAKING INCLUDING PROFILING

In accordance with Article 22, Paragraphs 1 and 4 of the GDPR, automated decision-making including profiling is not used on this website during the processing of your data.

11. YOUR RIGHTS AS A DATA SUBJECT

As set out in Article 15 of the GDPR, you have the right to information about the personal data concerning you. You can ask our Data Protection Officer or ourselves for information at any time.

If information is requested other than in writing, we ask for your understanding if we require proof that you are indeed the person you say you are.

You also have the right to rectification (Article 16 of the GDPR) or deletion (Article 17 of the GDPR) or the restriction of processing (Article 18 of the GDPR) to the extent that you are legally entitled to these rights. You also have the right to data portability (Article 20 of the GDPR). Article 21 of the GDPR also you the additional right, within the limits of the stipulations laid down by law, to object to the processing.

In addition to the rights listed above and irrespective of other legal remedies under administrative law or judicial redress, Article 77 of the GDPR gives you the right to lodge a complaint with a supervisory authority for data protection about our processing of personal data.
